Main Yemen oil export pipeline blown up, flow halted: officials

SANAA: Tribesmen blew up impoverished Yemen's main oil export pipeline on Thursday, halting the flow of its main source of foreign currency, security and oil officials said.

The Arabian Peninsula state, which relies on crude exports to finance up to 70 percent of budget spending, has suffered frequent bombings of its main pipeline in the central Maarib province since an uprising broke out in 2011.

"The attack has stopped the flow of exports, but we have engineering teams fixing the damage now and we expect that it will be repaired by tomorrow," said an oil ministry official.

Changes proposed to New Orleans area levee systems

[unable to retrieve full-text content]Less may mean more when it comes to the levee systems designed to protect New Orleans from hurricanes. That's the conclusion of a new study led by the co-developer of the authoritative computer model for storm surge used by the US Army Corps of Engineers, the Federal Emergency Management Agency and the state of Louisiana to determine water levels due to hurricane surge and to design levee heights and alignments.

Google Nexus, Amazon Kindle Fire: Best prices are coming soon

The Google Nexus 7 and Amazon Kindle Fire will both likely drop to their lowest prices yet as both companies seek to release newer, updated models of their tablets. Hold off on buying a new tablet for a little longer to see the best prices on the Nexus and the Kindle.

By Lindsay Sakraida,?Guest blogger / July 19, 2013

Amazon's Kindle Fire, Google's main competitor for its Nexus 7, is displayed at a news conference in New York, New York in 2011. Both the Nexus 7 and Kindle Fire will likely hit all-time low prices soon as Google and Amazon seek to release new models of their tablets.

We see hundreds of excellent deals every day here at dealnews, but sometimes a discount comes across our plate that actually tells a story. In the case of this Editors' Choice Google Nexus 7 deal, it's a story that predicts the refresh cycle for the Nexus 7, as well as future pricing for its competitor, the Kindle Fire HD.

Just yesterday we found a deal on the Google Nexus 7 16GB 7" Android Tablet that came within a buck of the lowest total price we've ever seen, dropping the 16GB slate to $149.90. Simultaneously, the 32GB version was cut to $169, another all-time low price. (And just $19 more!) But even though those deals are eye-poppingly cheap, it's important to keep one thing in mind: Google is scheduled to hold a press event next Wednesday. As such, these prices seem to validate the rumors that the corporation is about to debut a brand new generation for its flagship tablet.

Deals Before the Storm

While most electronics tend to see new price lows right before they're refreshed, this is especially true of tablets. In the past, reseller deals have preceded new iPads and Kindle Fire tablets, and it appears that such deals are now foreshadowing a new Nexus tablet. Whether this is a good deal to buy then depends on a few factors.

If Google follows the precedent that Amazon has already established, then the next generation Nexus will probably debut for the same starting price as the current generation. That means the refreshed model will only cost $199, or $49 more than the above deal. Keep in mind, however, that last year Amazon also kept its original Fire tablet in production at a lower retail price; if Google does the same with the original Nexus, its retail price could possibly fall to $159 (where the original Fire tablet currently resides). That means this current deal is still $9 less than what the retail price might be, come next week.

The Kindle Fire HD Is Next on the Deal Chopping Block

Last year, Amazon debuted its Kindle Fire HD tablets shortly after Google announced its Nexus line. The Amazon affair took place during the first week of September, and it seems likely that the megaretailer will target that general time frame once again for a refresh.

If resellers treat the current Fire HD like they have the Nexus 7, then we should begin seeing new all-time low prices on the Amazon slate in mid- to late-August. So far, the lowest the 16GB model has gone is $169, so anything below that ($149.90 maybe?) will be an Editors' Choice-level price cut. Look to stores like Best Buy, Staples, Office Depot, and eBay for special promotions.

Don't want to miss a deal? Sign up for an email alert now to receive product announcements and sales on both the Google Nexus 7 and the Amazon Kindle Fire HD.

Marathon bombing suspect on Rolling Stone cover

BOSTON (AP) ? A Rolling Stone cover story featuring a glamorous photo of Boston Marathon bombing suspect Dzhokhar Tsarnaev is generating controversy, with several retailers including CVS and Walgreens announcing Wednesday that they will not carry the issue.

The cover of the magazine's Aug. 1 edition is a photo in which Tsarnaev looks more like one of the rock stars that usually grace it than a suspect in the April 15 bombings at the marathon finish line that killed three and wounded more than 260. A preview on the magazine's website says the story by contributing editor Janet Reitman traces how "a bright kid with a charming future became a monster."

Rolling Stone editors said in a statement that the story falls within the traditions of journalism and the magazine's commitment to serious and thoughtful coverage.

"The fact that Dzhokhar Tsarnaev is young, and in the same age group as many of our readers, makes it all the more important for us to examine the complexities of this issue and gain a more complete understanding of how a tragedy like this happens," the statement said.

The cover was ill-conceived at best and reaffirms a message that destruction gains fame for killers, Boston Mayor Tom Menino wrote in a letter to Rolling Stone publisher Jann Wenner.

"Among those we lost, those who survived, and those who help carry them forward, there are artists and musicians and dancers and writers. They have dreams and plans," he wrote. "They struggle and strive. The survivors of the Boston attacks deserve Rolling Stone cover stories, although I no longer feel that Rolling Stone deserves them."

Three retailers based within 50 miles of the site of the bombings, including Rhode Island-based CVS and convenience stores Tedeschi Food Shops and Cumberland Farms in Massachusetts, said they will not carry the magazine. Walgreens, headquartered in Illinois, joined them in opting out of selling the issue.

"Tedeschi Food Shops supports the need to share the news with everyone, but cannot support actions that serve to glorify the evil actions of anyone," the chain said on its Facebook page. "Music and terrorism don't mix!"

One of the marathon runners, Lauren Gabler, who works in IT consulting in Washington and was running her fourth Boston Marathon this year, said she at first thought the Rolling Stone photo was of a model or rock star and was surprised when she realized it was Tsarnaev.

"The cover almost tricks you into what you're looking at," she said.

Gabler had finished the race and was two blocks away headed to brunch when she heard and felt the explosions. She was unhurt.

"I haven't read the article yet, and I know it will probably be quite in-depth, but my initial reaction is that the photo that's being used almost makes him look like a good guy," she said. "That's the story line, but I think the public will have trouble, like me, making the association between here's the Boston bomber and here's the guy who appears to be cool on the cover of Rolling Stone."

Tsarnaev has pleaded not guilty in the bombings.

Twitter road trips USA: send us travel tips for Las Vegas to Denver

Las Vegas Boulevard, The Strip, Las Vegas

Leaving Las Vegas ? for Utah ? and then Colorado. Photograph: David Levene for the Guardian

The Guardian is launching the fourth of its crowd-sourced, interactive road trips through the US on Monday 22?July.

I'll be covering my 1,000-odd mile route between Las Vegas, Nevada and Denver, Colorado in a rented car, sharing the driving with my friend Andy, and will be guided by your tips on accommodation, food, routes, sights to see and things to do ? in fact, in virtually every respect other than personal hygiene, I shall submit my will to yours, dear readers.

In return, I will be tweeting updates from along the route, asking for advice, and sharing reflections on this magnificent stretch of the US. I hope that together we'll be able to unlock some unusual experiences, barrel down empty?desert highways, have dreams of riches on slot machines, visit ghost towns, and conjure up the spirits of the?west.

Virtually none of the trip is pre-planned. We have a starting-point ? Las Vegas ? and an end-point ? Denver. Everything else is up for grabs. So please send along any suggestions you have for the itinerary, our objectives, music, snacks, and even the name of our?expedition.

As things stand, we'll be starting and spending a good chunk of the first day in Las Vegas. I've visited the city once before and stayed a couple of nights in a hotel that looked like a Lego castle. Where should I go this time? What are the must-sees? Should we be revelling in kitsch and gambling, or challenging our preconceptions about the city?

We'll be travelling with a photographer, the very talented Jacob Kepler, who is based in Las Vegas. Can you surprise him in his own backyard?

View Guardian TwiTrip: Las Vegas to Denver in a larger map

The next stretch will lead us north-east out of Nevada and into Utah. How do we take in the diversity of this great state? Should we go to the?Shakespeare festival in St George, or plunge into its national parks, or both, or neither? And, of course, Utah is the spiritual and cultural centre of Mormonism. Where do we go, how do we begin to understand that?

We'll be crossing into Colorado for the final leg of our journey. I'm American ? my dad is from Medford, Massachusetts ? but this part of the US is terra incognita to me. Both Utah and Colorado have a reputation for epic landscapes. What are the best places to see them? Help?free us from the blandness of the interstate and peer into the nooks and corners of the?country.

Our crew is brave and game for anything. We will accept any reasonable challenge, we are happy to drive long and far, but it may help to know that we especially love spicy food, outdoor swimming, friendly people, good coffee, independent bookshops, wide open landscapes, unspoilt nature, roadside Americana, tumbleweed, iconic motels, giant balls of string, pre-Columbian history, and pleasant surprises.

Tweet me ? if I'm not there, try @GuardianTravel or @GuardianUS, or GuardianWitness ? or leave your tip in the comments below ? We await our orders.

Vivus says FMC rejects offer to settle proxy fight

By Bill Berkrot

(Reuters) - Obesity drug maker Vivus Inc, embroiled in a bitter proxy war with its top shareholder First Manhattan Co, said on Wednesday that FMC had rejected an offer to give the sides equal representation on the board.

FMC responded by saying that it remains open to a fair settlement with the Vivus board, despite filing a lawsuit this week against the biotechnology company for postponing its annual shareholder meeting by three days. FMC said at the time of Monday's originally scheduled meeting it had the votes needed to seize control of the Vivus board.

Vivus also said its long-time Chief Executive, Leland Wilson, had offered to resign as part of the proposal rejected by First Manhattan, an investment firm that holds 9.9 percent of Vivus shares.

FMC has accused the company of bungling the marketing of its new diet pill Qsymia and of failing to install a management team with extensive commercial drug launch experience.

The rejected proposal was for four board representatives each from Vivus and FMC, and one independent investor representative, Vivus said. The four FMC nominees proposed would include three recommended by proxy advisory firm ISS plus a new CEO, Vivus said in a statement.

FMC appeared to have a different take on the settlement offer Vivus said it proposed.

"Vivus continues to insist on a board controlled by their current directors, despite their awareness of the likely voting results of the scheduled July 15 annual meeting, which they postponed," FMC said in a statement.

Despite the bitterness of the proxy battle, in which Vivus and FMC have accused each other of illegal or unethical practices, FMC said it had "reengaged in settlement discussions over the past several days, and offered that the reconstituted board be divided equally between FMC nominees and Vivus incumbents (including Leland Wilson), plus Tony Zook, the new proposed CEO."

The reconstituted board proposed by FMC would expand the current number of directors to 11 from nine.

Earlier this month, FMC took the unusual step of announcing that Zook, a former senior AstraZeneca executive, would be installed as the new Vivus CEO should it prevail in gaining control of the board.

Calling this "one of the ugliest biotech proxy fights in recent memory," Cowen and Co analyst Simos Simeonidis predicted an outright victory for First Manhattan in shareholder balloting.

Whether there is ultimately a settlement or a final board composition based on shareholder vote count, "we expect the majority of the current board and all of current senior management to be gone on Thursday or soon thereafter, including the CEO, president, CFO and chief commercial officer," Simeonidis wrote in a research note.

Vivus won U.S. regulatory approval for Qsymia last July and launched the product in September. Sales of the drug analysts said could be a blockbuster have so far been minuscule, leading to criticism from some shareholders that the company should have signed up a big pharmaceutical partner with deep pockets and a large sales force prior to the launch.

Vivus said in May that it had started talks with bigger companies on a potential Qsymia partnership.

Concerns regarding the drug's insurance reimbursement and a long history of safety issues related to obesity drugs have also held back sales, analysts say.

Vivus shares were up 37 cents, or 2.5 percent, at $14.77 in afternoon trading on Nasdaq - still about half their value at the time of the Qsymia approval a year ago.

Chrome beta for Android now has WebRTC for video chatting

WebRTC on Chrome beta

Support for live video and audio without installing any software comes with today's update.

Chrome beta for Android has been updated today, and while there are the standard performance improvements on-board, there's also a slick new feature or two -- support for WebRTC.

WebRTC is a free, open project that enables web browsers with Real-Time Communications capabilities via some simple Javascript APIs. It's been supported on the desktop in Chrome for a few versions, and is a joint project between Google, Mozilla and Opera.

What it can do for you is easy -- it let's you use the camera and microphone on your phone or tablet to video chat without installing any software. You're warned when you visit a site that requests the permission, and while using it a persistent notification is present. This way, there won;t be any funny business or snooping involved. Is it useful? Not yet, but when developers implement WebRTC on their site, it very well could be. In the meantime, it's very, very cool.

You can play around with this one yourself. Fire up Google Play and update Chrome beta, or hit the Google Play link above, then visit this link

(AP) ? When the courts have to figure compensation for people aboard Asiana Airlines Flight 214, the potential payouts will probably be vastly different for Americans and passengers from other countries, even if they were seated side by side as the jetliner crash-landed.

An international treaty governs compensation to passengers harmed by international air travel ? from damaged luggage to crippling injuries and death. The pact is likely to close U.S. courts to many foreigners and force them to pursue their claims in Asia and elsewhere, where lawsuits are rarer, harder to win and offer smaller payouts.

Some passengers have already contacted lawyers.

"If you are a U.S. citizen, there will be no problem getting into U.S. courts. The other people are going to have a fight on their hands," said Northern California attorney Frank Pitre, who represents two Americans who were aboard the plane.

Federal law bars lawyers from soliciting victims of air disasters for the first 45 days after the crash. Pitre said his clients called him.

Congress enacted that law in 1996 amid public anger over lawyers who solicited clients in the days immediately following the ValuJet Flight 592 crash in the Florida Everglades and the crash of TWA Flight 800 off the New York coast.

National Transportation Safety Board attorney Benjamin Allen reminded attorneys of the rules in a mass email sent Thursday.

"We are closely monitoring the activities of attorneys following this accident, and will immediately notify state bar ethics officials and other appropriate authorities if impermissible activity is suspected," the message said.

The flight that broke apart recently at the San Francisco airport was carrying 141 Chinese, 77 South Koreans, 64 Americans, three Canadians, three Indians, one Japanese, one Vietnamese and one person from France when it approached the runway too low and too slow. The Boeing 777 hit a seawall before skittering across the tarmac and catching fire.

Three girls from China were killed and 182 people injured, most not seriously.

Two girls, Ye Mengyuan and Wang Linjia, both 16, died right away. It is unclear, however, whether Ye Mengyuan died in the crash or in the chaotic aftermath. Both girls' parents appeared at a vigil Saturday near the airport, and thanked, through a translator, the more than 100 people in attendance for their support, KGO-TV reported. The other victim killed, 15-year-old Liu Yipeng, died Friday at a hospital where she had been in critical condition since the July 6 crash.

The dozens who were seriously injured ? especially the few who were paralyzed ? can expect to win multimillion-dollar legal settlements, as long as their claims are filed in U.S. courts, legal experts said.

Northern California attorney Mike Danko, who is consulting with several lawyers from Asia about the disaster, said any passenger who was left a quadriplegic can expect settlements close to $10 million if the case is filed in the United States. Deaths of children, meanwhile, may fetch in the neighborhood of $5 million to $10 million depending on the circumstances in U.S. courts.

In other countries, he explained, the same claims could be worth far less.

In 2001, a South Korean court ordered Korean Air Lines to pay a total of $510,000 to a woman whose daughter, son-in-law and three grandsons were killed in a 1997 crash in the U.S. territory of Guam that killed 228 people.

Broken bones in plane accidents usually mean $1 million settlements in the United States and in the low five-figure range overseas, Danko said.

In 2011, the Federal Aviation Administration put the value of a human life at $6 million when it was contemplating the cost-benefit of a new "cockpit resource management" regulation. But again, Danko said, that estimate applies only in U.S. courts. Foreign courts can be expected to pay far smaller settlements.

In all, the South Korean government agency that regulates that country's insurance industry expects Asiana's insurers to pay out about $175.5 million total ? $131 million to replace the plane and another $44.5 million to passengers and the city of San Francisco for damage to the airport. Suh Chang-suk, an official at Financial Supervisory Service, declined to discuss how the watchdog agency calculated its estimate.

The international treaty is commonly referred to as the Montreal Convention because of the Canadian city where it was drafted. It offers international passengers five options for where to seek compensation: where they live, their final destination, where the ticket was issued, where the air carrier is based and the air carrier's principal place of business.

Foreign passengers who had roundtrip tickets to final destinations beyond the U.S. face stiff legal challenges to pursue their claims against the airline in the United States, where courts are more receptive to lawsuits and the payouts larger than in the courts of most other nations.

Asiana can also invoke the America legal doctrine of "forum non conveniens" to argue that it's much more convenient for it to litigate the Asian victims' cases in Asia because all parties are based there.

South Korean attorney Suh Dong Hee represented some of the victims of the 1997 Korean Air Lines crash. He said family members of the victims who pursued their case in the United States settled for as much as 100 times more than those who sued in South Korea.

Brian Havel, director of DePaul University's International Aviation Law Institute, said the convention does require the airlines to make immediate "down payments" to victims to help with medical expenses, travel costs and other inconveniences caused by the crash.

"Everyone will get something," Havel said. "But who receives what does largely depend on where they qualify under the convention."

However, Pitre and others say, the foreign passengers are still able to sue others who may have contributed to the accident, such as the plane's manufacturer, airport personnel and even, perhaps, the first responders.

Pitre said he and his clients are investigating whether Boeing Co. shoulders any responsibility for the crash, including potential design flaws in the plane's automated instruments or differences between first-class passengers' seatbelts, which come with a shoulder strap, and the seatbelts in the economy section, which are lap restraints only.

Boeing spokesman Marc Birtel said the company buys seats from other companies and "simply installs them." He also said the seat belt designs and configurations are mandated by the Federal Aviation Administration. Birtel declined to discuss the other issues Pitre raised.

Authorities said Friday that 15-year-old Liu Yipeng was struck by a fire truck, although it's not clear whether that killed her. Some passengers who called 911 immediately after the crash also complained that the emergency response took too long. Those third parties and others are open to lawsuits in the United States.

San Francisco officials said ambulances could not immediately come too close to the plane out of concern the aircraft would explode.

"Thousands of people crowded telegraph offices around India to send the country's last telegrams, as the government shut down the 163-year old service on Sunday. On July 14, the last for the Central Telegraph Office in the Indian capital, most of the telegrams carried nostalgic messages and good wishes for loved ones. By late Sunday, with just a few hours to go before the doors closed for good, 1,500 telegrams had been processed -- compared to 10 to 20 on any other day." (07/14/13)

Zimmerman jury asks for 'clarificaton' on manslaughter charge

SANFORD, Fla--After more than 12 hours of deliberation, the jury in the George Zimmerman case has asked the court for "clarification" on the charge of manslaughter. The question is likely to make the defense nervous, since it suggests the all-female jury could be seriously weighing a conviction on the lesser charge in the case.

Both the prosecution and defense agreed that the jurors need to ask a more specific question, saying they cannot engage in "general discussions" about the charge. Judge Debra Nelson agreed to send the attorneys' response back to the jurors around 7:00 p.m. Saturday night.

Zimmerman, a 29-year-old volunteer neighborhood watchman, is charged with second-degree murder in the death of 17-year-old Trayvon Martin, whom the defendant shot during a scuffle in a nearby gated community on Feb 26, 2012. The jury was also told it could convict Zimmerman on the lesser charge of manslaughter, or acquit him as not guilty of any crime. Zimmerman argued he acted in self defense.

The jury was told in its instructions that a Zimmerman merited a manslaughter charge if he killed Martin intentionally.

The jurors deliberated for 12.5 hours--including a one-hour lunch during which they were allowed to discuss the case--before alerting the court they had a question. "May we please have clarification on the instructions regarding manslaughter?" the question read. The sequestered, anonymous jurors only made one other request during their deliberations--for an itemized list of all the evidence presented during the trial on Friday.

For the jury to convict Zimmerman of second-degree murder, the prosecution would have to prove that Zimmerman had ?a depraved mind without regard for human life? when he shot Martin. A lesser manslaughter conviction could be handed down if the jury believes Zimmerman had no lawful reason to kill Martin. Zimmerman is legally justified in killing Martin if the jury finds he had a ?reasonable? belief that his own life was in jeopardy or that he could suffer bodily harm from Martin.

In closing arguments Friday, Assistant District Attorney John Guy argued that it was the unarmed Martin who tried to defend himself. ?Ask yourself, ?Who lost the fight??? Guy said. ?That child had every right to be afraid of a strange man following him, first in his car and then on foot. And did that child not have the right to defend himself from that strange man??

Zimmerman?s attorney Mark O?Mara argued over three hours in his closing remarks that Martin was not ?unarmed.? He dragged out a chunk of concrete and laid it in front of the jury to make the point that Martin used the pavement as a ?weapon? against his client when he allegedly slammed his head against it in their scuffle.

Before beginning their deliberations, jurors received the following instructions pertaining to manslaughter:

MANSLAUGHTER
To prove the crime of Manslaughter, the State must prove the following two elements beyond a reasonable doubt:
1. Trayvon Martin is dead.
2. George Zimmerman intentionally committed an act or acts that caused the death of Trayvon Martin.

George Zimmerman cannot be guilty of manslaughter by committing a merely negligent act or if the killing was either justifiable or excusable homicide:
Each of us has a duty to act reasonably toward others. If there is a violation of that duty, without any conscious intention to harm, that violation is negligence.
The killing of a human being is justifiable homicide and lawful if necessarily done while resisting an attempt to murder or commit a felony upon George Zimmerman, or to commit a felony in any dwelling house in which George Zimmerman was at the time of the killing.

The killing of a human being is excusable, and therefore lawful, under any one of the following three circumstances:
1. When the killing is committed by accident and misfortune in doing any lawful act by lawful means with usual ordinary caution and without any unlawful intent, or
2. When the killing occurs by accident and misfortune in the heat of passion, upon any sudden and sufficient provocation, or
3. When the killing is committed by accident and misfortune resulting from a sudden combat, if a dangerous weapon is not used and the killing is not done in a cruel or unusual manner.

In order to convict of manslaughter by act, it is not necessary for the State to prove that George Zimmerman had an intent to cause death, only an intent to commit an act that was not merely negligent, justified, or excusable and which caused death.

If you find George Zimmerman committed Manslaughter, and you also find beyond a reasonable doubt that during the commission of the Manslaughter, George Zimmerman carried, displayed, used, threatened to use, or attempted to use a firearm, you should check the appropriate box on the verdict form which I will discuss with you later in these instructions.

Baseball: Lincoln-Way North an ‘ideal situation’ for Mitch Nowicki

Playing two years on the varsity level as a catcher under former Naperville Central coach Bill Seiple before playing collegiately at Illinois Wesleyan, there?s little doubt Mitch Nowicki knows the intricacies of baseball.

Spending the spring on the varsity staff of Joe Skarbek at Lincoln-Way North as the hitting coach after spending time coaching at the sophomore level, Nowicki gets his chance to mold the varsity program into his own.

Officially named in May as the replacement at North for Skarbek, who left to become an assistant principal at Lincoln-Way East, Nowicki couldn?t have asked for a better situation to walk into as a first-time head coach.

?It?s been a pretty smooth (transition). Coach Skarbek did a good job of kind of walking me through things as the year went on,? he said. ?It was more managerial side than it was the baseball side, but all the extras you have to deal with. So it?s been a good transition. We had a really good baseball camp, and the summer varsity team is doing pretty well.?

Nowicki, who learned of his promotion to the top job on May 7, inherits a program that has won at least 30 games in three straight seasons while winning four straight regional crowns.

?The program has been very successful in a short amount of time and I?m excited. I?ve been a part of it from the get-go, so that?s also a nice thing that I?ve always been associated with the program,? he said.

North was 33-3-1 in 2013, falling to Lincoln-Way East in the Class 4A Providence Sectional. The Phoenix tied the program record for wins with 33 in the midst of staying at or near the top of the state rankings for much of the season.

The task for Nowicki, a 2001 Naperville Central graduate, is to keep the Lincoln-Way North train moving.

?It?s kind of been an ideal situation,? he said. ?My guys that will be seniors ... I was their head sophomore coach, so we?re on the same page, as far as my philosophy. They understand kind of who I am as a coach. They were very successful. I think we were 34-2 as a sophomore group and now I have those guys as seniors with my first varsity year. I?m real excited about it. It?s an ideal situation.?

Nowicki becomes the fourth Redhawks baseball alum to earn his shot as a varsity baseball coach in recent years, joining Justin Cronin, a fellow 2001 graduate, Scott Lawler and Mike Stock.

Cronin spent two years as the varsity baseball coach at Hinsdale Central from 2011 to ?12, while Lawler and Stock each finished their second years at the helm of the programs at Benet and Naperville Central, respectively, in the spring.

Nowicki hasn?t been afraid to call on the wisdom of both Seiple and Stock, his freshman baseball coach at Naperville Central, as he has worked up the ranks in his coaching career at both Lincoln-Way East and Lincoln-Way North.

?(Seiple) has always been kind of like an extra father figure, ever since playing for him in high school and throughout my teaching (career),? Nowicki said. ?He?s always been a guy where I could shoot an email and say, ?Hey, what do you think about this?? (Seiple) and coach Stock were the same way. I think my first congratulations email was from coach Stock.?

Acer Aspire P3-171-6820

The Acer Aspire P3-171-6820 is a cleverly designed hybrid/convertible tablet featuring a ten-point touch-screen, an ultra-low voltage Core i5 processor, a Bluetooth keyboard case, and a 120GB solid state drive. The keyboard comes in handy for those times when only a keyboard will do, but it doesn't do a very good job of supporting the tablet and it doesn't have a touchpad. Priced at just under $900 (list) it is relatively affordable as far as hybrid go, but it can't match the performance of similarly priced hybrids, including our current Editors' Choice, the Microsoft Surface Windows 8 Pro.

Design and Features
The P3-171-6820 is wrapped in a sleek brushed silver aluminum chassis that weighs 1.7 pounds and measures 11.6-by-7.5 -by-0.04 inches (HWD). A micro-HDMI port and a full-size USB 3.0 port share space on the left side of the tablet with a microphone, rest button, and the power jack. On the right side are a headphone/speaker jack, the power button, a battery status indicator, and a volume key. There are two air vents on the top, a rear-facing five-megapixel camera on the back, and a 720p HD camera embedded at the top of the screen.

There are two small speakers embedded in the bottom of the tablet. Combined with Dolby Home Theater software they deliver a much bigger sound than their size would indicate, although bass response is non-existent. Missing is a card reader slot.

The 11.6-inch glossy screen has a maximum resolution of 1,366-by-768, which is disappointing as it can't display video in full (1080p) high-definition like the Microsoft Surface Pro and the Samsung ATIV SmartPC Pro 700T (XE700T1C-A01US). However, it does a good job with 720p content, delivering rich colors, sharp imagery, and good viewing angles. The screen uses 10-point touch technology, which provides effortless and accurate swiping, gesturing, pinching, and zooming.

Unlike the Sony VAIO Duo 11 (D11213CX) and Samsung 700T, the Aspire P3's keyboard is detached and stays that way as it uses Bluetooth technology to communicate with the tablet. Simply snap the tablet into the keyboard case, press the power button on the upper part of the keyboard deck, slide the screen into the groove above the keyboard, and you're ready to type. Be careful, though; the tablet doesn't sit very snug in the groove and can be knocked loose with slight pressure to the top of the screen.

Typing is relatively comfortable but those with big hands may feel a bit cramped. There's no room for a touchpad here either, but there is a mini-USB port on the upper left side. The black textured keyboard case adds 0.78-inch to the P3-171-6820's overall thickness and 1.32-pounds to the overall weight.

The 120GB drive comes loaded with Windows 8 and the usual assortment of apps including Skype, Amazon Kindle, Netflix, and trail versions of MS Office and McAfee Internet Security Suite. There's also eShopping, eReading, and iCookbook programs, as well as Acer Cloud and Nero Backitup software.

Rounding out the feature set are Wi-Fi a/b/g/n and Bluetooth 4.0 radios, a mini-USB to full-sized USB adapter (for use with the keyboard), and a micro-HDMI to VGA video dongle. Acer covers the P3 with a standard one-year warranty.

Performance
Acer Aspire P3-171-6820 The Aspire P3 is powered by a 1.5GHz Intel Core i5-3339Y processor, 4 GBs of memory, and Intel's integrated HD Graphics 4000 GPU. It's score of 3,750 trailed the Surface Pro (4,768) by more than 1,000 points and the Samsung SmartPC Pro 700T by around 700 points. The P3 came in last on our Cinebench R11.5 CPU test with a score of 1.80 while the Surface Pro scored a 2.39.

Acer Aspire P3-171-6820

Multimedia performance was similar; the Aspire P3's Photoshop (8:25) and Handbrake (2:01) encoding times were significantly longer than the Microsoft Surface Pro (6:11 and 1:28, respectively), while the Core i7-fueled Asus Transformer Book TX300C led the pack.

Most tablets come up short when it comes to gaming and the Aspire P3 is no different. It managed a paltry 8 fps on our medium quality Alien vs. Predator test and 7 fps on our medium quality Heaven benchmark test. On the plus side, video played smoothly without any sign of chop or stutter.

The Aspire P3's 4-cell lithium-ion battery lasted 5 hours 11 minutes on our battery rundown test. That's right up there with the Samsung ATIV Smart PC Pro (5:12) and a bit longer than the Dell XPS 12 (5:09), the Lenovo IdeaPad Yoga 13 (5:00), and Microsoft Surface Pro (4:58). The Asus TX300C held onto its lead with a battery time of 7:35, but it needed two batteries to do so. Without the help of the secondary keyboard case battery, the Transformer Book lasted 4:47.

With the Acer Aspire P3-171-6820 you get a tablet and an Ultrabook in one slim, affordable package. Its 10-point touch-screen is ideal for swiping your way through Windows 8 apps, and you'll never have to worry about reattaching the Bluetooth keyboard (but you may want to take care not to knock the tablet off its perch while typing). Its battery provided over five hours of unplugged computing power, but when it came to performance, it couldn't keep pace with the competition. If you can spare an extra $100, the Editors' Choice Microsoft Surface Windows 8 Pro offers better performance as well as a 1,920-by-1,080 screen, a digitizer pen, an SDXC card reader, and a slightly bigger solid-state drive.

'I felt sick to my stomach': Boston Marathon bombing survivors watch as Tsarnaev pleads not guilty

Dzhokhar Tsarnaev holds up a bandaged at his arraignment on Wednesday.

By Matthew DeLuca and Tracy Connor, NBC News

Friends and family members of people whose lives were shattered when two homemade bombs went off near the finish line of the Boston Marathon on April 15 packed three rooms in a federal courthouse on Wednesday as suspect Dzhokhar Tsarnaev pleaded not guilty to a 30-count indictment.

But the fleeting courtroom encounter brought little relief to Bostonians who said the 19-year-old ?accused of conducting the deadly bombings with the help of his older brother Tamerlan Tsarnaev ?showed little feeling.

?He came out and he smirked at the families,? said Ed Fucarile, 64, outside of the John Joseph Moakley federal courthouse along the water in South Boston. ?The lawyers put their hands on his shoulders like it was going to be all right.?

Tsarnaev, seated between his lawyers in an unbuttoned orange jumpsuit and black t-shirt with a bandage around his left hand, responded ?not guilty? to each of the charges read against him in court. At times he stroked his chin, smiled crookedly, and appeared to look calmly about the courthouse.

Fucarile wore a Boston Strong t-shirt with the name of Marc Fucarile, his son who lost his right leg and still carries shrapnel in his body, the father said.

Marc Fucarile, 34, was standing near the second blast when it went off. He still has more surgeries to go, and has spent every day of the nearly three months since receiving medical care, his father said. Members of the family have taken weeks off work so that someone is always at Marc?s bedside, he said.

Brian Snyder / Reuters

Massachusetts Institute of Technology (MIT) police officers stand outside the federal courthouse for the court appearance by accused Boston Marathon bomber Dzhokhar Tsarnaev in Boston, Mass., on July 10.

?I expected a lot more,? he said of Tsarnaev?s eight-minute hearing on Wednesday. ?It wasn?t what I thought it was going to be.?

Mildred Valverde, 44, after coming out of the courthouse on crutches, said the hearing was emotionally taxing.

?Just to be in the same room with him was bothersome,? Valverde said, adding that she hopes that, if convicted, he doesn't get the death penalty.

"I'd rather see him suffer," she said. "Death is too quick."

Scores of survivors and their supporters crowded into two overflow rooms in the courthouse to watch Tsarnaev?s appearance on television screens. About 30 more, including some who stood glaring with their arms crossed as Tsarnaev was led from the courtroom by U.S. Marshals, filled seats in the main courtroom. It was the alleged bomber?s first court appearance since he was captured by law enforcement, bloodstained and hiding in a boat, on April 19.

Among those present was Liz Norden, whose sons J.P. and Paul Norden each lost a leg in the April blasts.

?I felt sick to my stomach,? Liz Norden told dozens of reporters outside the courthouse after the hearing. Asked what she would tell her sons about the day, she said they have focused all their attention on recovering from their injuries.

Victim and family members of the Boston Marathon bombing describe the proceedings of the Dzhokhar Tsarnaev court hearing.

?They don?t ask,? she said. ?They don?t want to know.?

Peter Brown, the Norden brothers? uncle, said he did not expect to feel anything when he saw Tsarnaev in court.

?I didn?t have any emotion,? Brown said. ?I didn?t expect to see anything else. We believe in the justice system and will let that take its course.?

Three people were killed and more than 260 injured in the bombings that shattered a beloved springtime rite in the city. The deceased were Martin Richard, 8; Krystle Marie Campbell, 29; and Lingzi Lu, 23.

Also killed in the course of the manhunt after the bombing was Sean Collier, 27, an officer with the Massachusetts Institute of Technology police department who was shot dead in his patrol car on April 18.

Liz Norden, the mother of two men who each lost a leg in the Boston Marathon bombings, tells WHDH "I want to know what happened that day," as she prepares to attend a federal hearing for suspect Dzhokhar Tsarnaev. Janet Wu reports.

Nearly? two dozen representatives of the MIT campus police department arrived at the courthouse before the hearing and remained outside, in uniform and attention, until after it was over.

?I didn?t see a lot of remorse. I didn?t see a lot of regret,? MIT Police Chief John DiFava, who was in the courtroom, said after the proceeding.

Tsarnaev's sisters were also in the courtroom, and at least one of them was crying. Outside, a small group of supporters cheered as a caravan carried him past, invoking his nickname as they yelled "Justice for Jahar!" according to the Associated Press.

Prosecutors said they expect the trial will last three to four months and they anticipate calling 80 to 100 witnesses. The next court date is Sept. 23.

Attorney General Eric Holder has not yet decided whether to seek the death penalty for Tsarnaev, an ethnic Chechen and American citizen who was born in Dagestan.

Investigators say the motive for the bombing might be found in anti-American messages the college student scrawled in the boat where he was found April 19: "The U.S. Government is killing our innocent civilians," "I can't stand to see such evil go unpunished," and "We Muslims are one body, you hurt one you hurt us all."

After the FBI identified the brothers as the bombing suspects, they embarked on a bloody escape bid ? allegedly executing Collier, hijacking a car and hurling pipe bombs at police.

Tamerlan Tsarnaev was killed in a firefight, but Dzhokhar fled and remained at large during a daylong lockdown that ended when a Watertown, Mass., homeowner noticed blood on the boat in his backyard.

The suspect was taken from the boat to a Boston hospital where some of his victims were still recovering. He was later transferred to a federal prison with medical facilities.
