Judge awards iPhone user $850 in throttling case

SIMI VALLEY, Calif. (AP) ? A judge in Southern California on Friday awarded $850 to an iPhone user because AT&T Inc. reduced his download speeds in an attempt to manage usage on its network.

Pro-tem Judge Russell Nadel found in favor of Matt Spaccarelli in Ventura Superior Court in Simi Valley. Spaccarelli filed a small claims case against AT&T last month, arguing the communications giant unfairly slows speeds on his iPhone 4's unlimited data plan.

Nadel's ruling could pave the way for others to follow suit. AT&T has some 17 million customers with "unlimited data" plans that can be subject to throttling, representing just under half of the company's smartphone users.

AT&T stopped signing up new customers for those plans in 2010, and warned last year that it would start slowing speeds for people who consume the most data. In the last few months, subscribers have been surprised by how little data use it takes for throttling to kick in ?often less than AT&T provides to those on limited or "tiered" plans.

Spaccarelli said his phone is being throttled after he's used 1.5 gigabytes to 2 gigabytes of data within a new billing cycle. Meanwhile, AT&T provides 3 gigabytes of data to subscribers on a tiered plan that costs the same ? $30 per month.

It wasn't immediately known whether AT&T would appeal the decision. AT&T area sales manager Peter Hartlove declined comment after Nadel's ruling. He argued in court that his employer has the right to modify or cancel customers' contracts if their data usage adversely affects the network.

Companies with as many potentially aggrieved customers as AT&T usually brace themselves for a class-action lawsuit. But in its subscriber contract, the Dallas-based company prohibits customers from taking their complaints to class actions or jury trials. The agreement specifies that customers must go to arbitration or small claims court instead. The Supreme Court upheld that clause last year.

Arbitration and small-claims court cases are cheaper and faster than jury trials, but they force plaintiffs to appear in person and prepare their own statements. In a class-action suit, the work can be handled by one law firm on behalf of millions of people.

That means thousands ?and possibly hundreds of thousands? of people who feel abused by AT&T's policy could seek to challenge the company, one by one, in arbitration or small claims court. The customer contract specifies that those who win an award from the company in arbitration will get at least $10,000. Spaccarelli picked the same amount for his claim. Judge Nadel instead awarded him $85 for each of the 10 months left on his contract.

Earlier this month, a Southern California woman won a small-claims action against Honda over the gas mileage she got out of her Civic hybrid car. She was awarded $9,867. Meanwhile, a class action against Honda over the same issue netted Civic owners a few hundred dollars each. The plaintiff, Heather Peters, is an ex-lawyer who had opted out of the settlement.

AT&T's throttling of "unlimited" data comes as it tries to deal with limited capacity on its wireless network. When the iPhone was new, AT&T had ample capacity on its network, and wanted to lure customers with the peace of mind offered by unlimited plans. Now, a majority of AT&T subscribers on contract-based plans have smartphones, and the proportion is growing every month. That's putting a big load on AT&T's network.

Verizon Wireless and T-Mobile USA also throttle users, but their policies are gentler. Verizon only throttles if the specific cell tower a "heavy user" subscriber's phone is communicating with is congested at that moment. T-Mobile's throttling levels are higher for the same price, and the levels are spelled out ahead of time. AT&T subscribers have no way of knowing if they'll be throttled before a warning message drops in. If they keep using their phones, throttling kicks in a few days later.

'No-fly' Muslim takes case to court of public opinion

PORTLAND, Ore. ? Mustafa Elogbi is by nature a private person. But when he finally arrived home after a frightening ordeal with U.S. security officials that cost him six weeks and thousands of dollars, he chose the spotlight.

Elogbi is seeking publicity and threatening legal action against the government for what he says was virtual exile by the U.S. government despite concerns about how the publicity might affect his family.

"I worry about my kids -- there are a lot of good people, but there are some who could try to harm them," the 60-year-old Libyan-American said Monday after clearing Customs at Portland International Airport. "But I think we really didn?t have any other choice."

On Jan. 4, after visiting family and friends in Libya, Elogbi headed home from Tunis, Tunisia, to the United States, where he is a citizen and resident of 33 years. But when his flight landed at London?s Heathrow Airport, he was detained and questioned by security officials who he says told him they were acting on behalf of Washington.

They told him he would not be able to board a flight to the United States, and instead locked him up in solitary confinement at a British detention center for two days, then placed him?on a flight back to Tunis.

Elogbi was shaken and humiliated. His wife, Annie Petrossian, contacted a Portland lawyer immediately, but Elogbi was at first leery of confronting the government.

But his options were limited. Because he was apparently on the U.S. secret "no-fly" list, he could not board any flight to the United States or Canada, which also enforces the list.

The Terrorism Screening Center, operated by the FBI, as a matter of policy, will not confirm nor deny the inclusion of a given person on the no-fly list. About 500 U.S. citizens are on the list, said a representative at the TSC, who asked not to be named. The total number of names on the list -? which includes "known or suspected terrorists" stands at about 21,000.

The Council for American Islamic Relations says it regularly fields calls from Americans ?- mostly Muslims -- who are prevented from boarding and believe they are on the no-fly list. Less than half of those who contact the organization pursue legal action, and fewer still seek publicity, according to CAIR staff attorney Gadeir Abbas. He says this is especially true if they are within the United States, and can take a car or train home.

"Part of the reason people don?t share that they are on the no fly list ? (is that) being on the list could have implications for their relationships or standing in the community," said Abbas. "It is a public declaration that the government for whatever reason is suspicious of you."

A few American citizens who have been prevented from boarding flights have made their way back to the United States by boat, train and car. And Abbas said some give up.

"There are definitely folks who were abroad, found themselves on the no-fly list and never returned,? said Abbas. "If the U.S. is impeding your travel back to the U.S ?. it?s just a small jump to speculate about what could happen to you when you return."

But Elogbi said he never considered staying away.

"I lived here for 33 years. Basically I?m an American guy," he said. "This is my home. They cannot chase us out of this country. It?s not going to make me run away from the United States."

With the help of two attorneys, and his wife?s persistent calls to U.S. agencies and her senator, Elogbi ultimately was allowed to fly home. He was required to fly on a U.S. carrier, on an itinerary approved by the U.S. Embassy in Tunis, which was communicating about the case with Washington.

He did not submit to questioning by an FBI agent who contacted him in Tunis, he said, because he wanted a lawyer present. When he did fly, he did so with his Portland lawyer, Tom Nelson, who had escorted another client, Jamal Tarhuni, back from Tunis a week earlier.

Upon arrival, Elogbi was taken aside at U.S. Customs for questioning ? and Nelson was not allowed to be present, the two said. Border authorities confiscated Elogbi?s cell phone and told him to retrieve it later this week at the Portland FBI field office.

The FBI and the State Department have repeatedly declined to comment on the cases, citing privacy concerns.

There are currently two major legal challenges to the Justice Department over its no-fly list.

This could become a third, according to Nelson, who has at least one more no-fly client overseas. He has also been seeking assistance from Sen. Ron Wyden, D-Ore., who is the chair of the Senate Select Intelligence Committee, and the press.

"I want to put a spotlight on these people (in the security apparatus," said Nelson. "They want to put a spotlight on me or on us? -- that?s fine. Bring it on. But let?s play by the rules here, let?s play by the Constitution that they are sworn to uphold."

We picked up our local paper last Tuesday to read the lead story: that Kenya would begin a strong contraceptive push to bring down its population growth in the next 20 years. Key to the article was the easy-to-miss one-line admission that foreign aid to East Africa is now dependent on the EA community?s acceptance of western birth control policies. In other words, Kenya either pushes birth control and gets foreign aid or ignores it and sees the funds dry up. Instead of looking around at the real demographic crisis looming (hint: it?s not overpopulation) in European nations like Greece, Italy, and Spain, the Kenyan government has been eager to assure WHO representatives that it will, indeed, work to make sure there are fewer Kenyans in the next generation. This is tragic.

When the prevailing worldview proclaims that people are the problem and that the answer to poverty is fewer people, what else can we expect? China?s firm belief in population control has meant the deaths of millions of Chinese girls by sex-selective abortion (and many other Asian nations have followed suit). In the meantime, Russia?s birthrate has fallen to such lows that Prime Minister Putin is running for office on a platform of paying families to have children. But promising tax-funded benefits is like throwing gasoline on the fire in the hopes of putting it out. Greece is now crumbling beneath the weight of its impossible-to-balance welfare state (not enough young people/taxpayers to support the growing list of retirees on state pensions). So what?s the answer?

The family economy. A vibrant household economy (where homes are a center of production instead of rampant consumerism) is the stable foundation of national economies. I?ve got an article in the works about the vital career of the home for women (married and unmarried). Cars with No Proof of Insurance Would Be Towed under SC Bill

A bill introduced to the South Carolina Legislature would make it so that drivers who don?t have car insurance coverage could get slapped with fines and a handful of towing and storage fees if they get caught on the road, according to Online Auto Insurance.

House Bill 4446, sponsored by Rep. Tom Corbin, would require police to impound the cars of drivers who cannot provide proof of insurance coverage when stopped.

The owner of the vehicle would then be fined $350 and would have to pay for any fees related to the towing and storage of the vehicle.

Such a law could provide some additional incentive for drivers to stay covered under a policy, especially in light of the fact that in the end offenders will have to purchase a policy and present proof of that coverage in order to get their cars back.

That could be doubly difficult considering the fact that the car owner?s registration and driving privileges are suspended upon a conviction of driving without coverage.

Vehicles that are not retrieved within 90 days would be considered abandoned vehicles.

Rep. Corbin introduced the towing bill at the end of November, and it is currently being considered in the House Committee on Labor, Commerce and Industry.

For The Love Of Haiku ? allaboutlemon

I love to write poems, short stories ( fiction or non-fiction)? but sometimes I need a muse and the perfect mood to start with a new one. Well aren?t we all writers feel this way?

Aside from writing , I love to create too. ?I love and enjoy arts. ?I also like to take photos to anything that caught my eye. ?Anyways, each of us here in the blogging community has something to offer in the world. ? I believe that we all are here and that we are doing what we are doing now in the blogging world for a reason or just because?

Since, I started my Art Game, I noticed that I gained more friends. ( I prefer to call my followers as my friends or buddies here in the blogging community). Although all are not participating but in one way or another I get to know other bloggers through them. ?Awesome, isn?t it?

Because of this I thought of something for those who just love to write like me? so how about we do something ?For The Love Of Haiku?? And that is how I?d like to call this some kind of fun or mind-game.

Everyone is welcome to join me in this fun just because you love what you are doing and you are happy to do it.

Every third Saturdays of the month I will post an image that I got from ?my Art Game and then you write down your Haiku based on what you see on the image.
