The Indianapolis Colts have announced that Chuck Pagano will be the team?s new head coach.? But Chuck Pagano won?t be available to the media until 3:00 p.m. ET on Thursday.

In the interim, the Colts have made available to the media Chuck Pagano?s brother, John, who happens to be the new defensive coordinator of the Chargers.

John Pagano, who reportedly won?t be joining Chuck in Indy (the fact that John is under contract with the Chargers may have been a factor in that), spoke via conference call, and the Colts have sent out the quotes from the Chargers defensive coordinator in an email bearing an oversized version of Indy?s horseshoe logo.

Yes, it all seems a little bizarre.? But at least there were no song lyrics in any of John Pagano?s answers.? (We think.)

?I think they are going to respond really well,? John Pagano said as to the reaction of the Indianapolis fans to his brother.? ?I think he?s a defensive-minded coach with fire and passion. He?s going to bring a different energy to the city of Indianapolis.?

As to the biggest strategic question ? whether Chuck Pagano will install a 3-4 defense ? John Pagano said that both 4-3 and 3-4 elements likely will be used.

?It?s funny because I got the same types of questions when I took the [job] in San Diego,? John Pagano said.? ?They said I was a 3-4 guy, but I?ve coached in a 4-3 and a 3-4. We do multiple fronts and we have multiple looks. Baltimore was a 4-3 and a 3-4. They play those different types of hybrid defenses that really are game-changing types of defenses.? Whatever your personnel suits you, you?re going to be in certain types of fronts and certain types of coverages whether it?s a 3-4 or a 4-3.

?The biggest difference between a 4-3 and a 3-4 is that you have a lot more linebackers in a 3-4 and you have a little bit bigger linebackers who can standup and come off the edge, which are just like 4-3 defensive ends. When you go to a sub package or a nickel package look, our outside linebackers here in San Diego are defensive ends.? They are used to standing up and playing with their hands down.? I would suggest multiple looks and multiple fronts.?

John Pagano also answered a question regarding the status of impending free agent defensive end, who technically remains under contract with the Colts until March 13.? ?When you have an impact rusher like Robert Mathis, you can see the presence he brings off the edge,? John Pagano said.? ?In anybody?s defense, in anybody?s scheme, Robert Mathis would make a difference.? To be able to have him coming off the edge, I think [Chuck] would most welcome that.?

Another Colts player?s name wasn?t mentioned at all during the John Pagano conference call.? It?ll likely be mentioned a few times this afternoon.

U.S. hopeful on Myanmar sanctions but action may be slow (Reuters)

WASHINGTON (Reuters) ? The United States is looking at easing sanctions on Myanmar, but needs to see more democratic progress including a smooth April by-election before it can start unwinding decades of overlapping economic and political bans on the country, U.S. lawmakers said on Tuesday.

U.S. officials have said they are encouraged by Myanmar's reforms thus far, which have included the release of hundreds of political prisoners and spurred the European Union and Australia to begin easing their own sanctions.

But the U.S. sanctions, launched in 1988 and expanded by five laws and four presidential directives, could prove tough to unravel quickly as the Obama administration monitors whether Myanmar genuinely embraces democracy, promotes civil liberties and ends strife with ethnic groups.

"We're looking at it. We're reviewing right now what's available to the president, what's available to Congress, what makes the most sense," said Democratic Senator John Kerry, who chairs the Senate Foreign Relations Committee.

"I think we have to take some measures in response to what is happening over there. But I don't think anybody's yet decided on exactly what the sequencing is," he said.

U.S. Secretary of State Hillary Clinton this month announced Washington would return an ambassador to Myanmar after an absence of two decades, a significant step in the quickening but still tentative re-engagement with the country formerly known as Burma.

RAPID CHANGE

Clinton, who visited Myanmar in December, has promised to match further reform steps with more U.S. gestures, hoping to encourage political change undertaken by the new civilian-led government after decades of military rule.

Those reforms, unveiled rapidly in recent months, have included freeing longtime pro-democracy leader Aung San Suu Kyi, launching peace talks with ethnic rebels, relaxing strict media censorship, lifting bans on trade unions and protests, and pulling back from the powerful economic and political orbit of neighboring China.

But Myanmar's generals still effectively control parliament after a deeply flawed 2010 election and the constitution, written in 2008, guarantees the military's dominant role in politics.

U.S. sanctions on Myanmar include a ban on investment and trade, a freeze on the assets of certain Myanmar officials and a block on U.S. support for loans from international financial institutions.

"There is a whole elaborate maze of sanctions that has been built up, and to dismantle it is going to take some time and effort," said Suzanne DiMaggio, vice president of global policy programs at the Asia Society and a Myanmar expert.

In Congress, leading lawmakers said the United States could begin loosening some sanctions soon - but probably not before the April 1 by-elections in which Suu Kyi is set to run for parliament.

"We could act fairly soon," said Republican Senator John McCain, just back from a trip to Myanmar, adding that both political parties and the Obama administration itself were consulting on the steps forward.

"The president can act on some, Congress has to act on some," McCain told Reuters.

U.S. officials have said they are looking for concrete progress on a number of fronts, including further prisoner releases, sustained peace initiatives with ethnic rebel groups and a halt to Myanmar's military cooperation with North Korea.

Senate Minority Leader Mitch McConnell, a Republican who since 2003 has been a co-sponsor of annual legislation placing sanctions on Myanmar's government, said the April election would be an important test of the durability of reform.

"I recommended to them that they have international observers there. That's not uncommon in countries that are having first-time elections," McConnell, who this month visited the country for the first time, told reporters.

"If that (election) goes well, then we'll continue to take a look at what additional steps they need to take in order to warrant the removal of some or all of the sanctions."

WAIVERS AND OTHER STEPS

Analysts say the United States could take initial steps such as requesting waivers to existing sanctions, including some to permit travel by senior officials to match the move taken this week by the European Union.

Another possible step would be an administration request for a waiver to a law which requires the United States to block any full re-engagement with Myanmar by the World Bank and the International Monetary Fund.

Some sanctions might be amended, but still others would require progress on issues ranging from drug trafficking and money laundering to preventing the use of child soldiers.

DiMaggio of the Asia Society said it would be important for the United States to maintain its flexibility while encouraging further reform, particularly on the economic front.

"What is needed right now are ways and means of responding quickly," DiMaggio said. "There is an urgency because right now a lot of important decisions are being made, a lot of reforms are being implemented, and they need assistance."

On Tuesday, the 48-year-old singer appeared on The Ellen DeGeneres Show, where he continued to open about up about his recent separation from wife Heidi Klum, 38. (Seal first addressed their split during an interview with PBS talk show host Tavis Smiley.)

"I am still wearing my ring. I think it's just pretty much a token of how I feel about this woman. We have eight years. Eight wonderful years together," Seal told host Ellen DeGeneres, 53. "Just because we have decided to separate doesn't necessarily mean you take off your ring and you're no longer connected to that person."

Despite his sudden split with Klum, Seal said he has "tremendous admiration, respect and love" for the German supermodel.

"Will we wear the rings for the rest of our lives? Who knows?" he wondered. "But right now it feels really comfortable on my hand, so I have no intention of taking it off anytime soon."

The couple, who wed in 2005, have three biological children: Henry, 6, Johan, 5, and Lou, 2. In 2009, Seal adopted Klum's 7-year-old daughter, Leni, from her previous relationship with Flavio Briatore.

"Heidi has given me four incredible gifts: four beautiful children. She still, in my opinion, is the most wonderful woman in the world," Seal said. "I think our priority was to remain civil and do this thing with dignity. We still very much love each other."

US files charges against Megaupload in 'largest copyright case'

US prosecutors say that the video-sharing site Megaupload.com cost the US entertainment industry $500 million. Online activists worry the US case could stifle Internet freedoms around the world.

In New Zealand, police had to cut through an iron door of a safe room to get their fugitive, Kim Dotcom, the founder of an Internet-based video sharing site called Megaupload.com.

Mr. Dotcom (a German citizen born as Kim Schmitz), along with six of his colleagues, has been charged with criminal copyright infringement, racketeering, and money laundering.

Meanwhile, a worldwide network of hackers took up the battle on behalf of Megaupload.com, launching a massive denial-of-service attack on several entertainment websites, as well as on the US Department of Justice website.

The mayhem and legal proceedings are just the opening shots in what US prosecutors are calling the largest criminal copyright case ever, and involves $500 million in damages to the entertainment industry, as well as complex legal issues of what constitutes copyright infringement in the age of YouTube, Facebook ?liking,? and DVD burners. And the legal battle is likely to reverberate around the world, as countries contemplate their own laws over intellectual property rights.

If found guilty, Dotcom and his Megaupload associates ? who are thought to have earned up to $175 million by selling advertisements on their website ?could face 20 years in prison.

The Washington Post quoted Sen. Patrick Leahy ? author of the controversial Protect IP Act (PIPA) ? praising the arrest of Dotcom.

?Today?s action by the Department of Justice against the leaders of Megaupload.com shows what law enforcement can do to protect American intellectual property that is stolen through domestic Web sites,? the Post quoted Leahy saying.

The New York Times quoted?Ira P. Rothken, a lawyer for Megaupload, as saying in a Times phone interview, ?Megaupload believes the government is wrong on the facts, wrong on the law.?

Turks march in Paris to denounce genocide bill (AP)

PARIS ? Thousands of Turks from across Europe marched through the French capital Saturday denouncing a bill that would make it a crime to deny that the killing of Armenians by Ottoman Turks nearly a century ago was genocide.

Turks young and old, waving their country's red flag, or wrapped in it, marched to the Senate, where the bill will be debated Monday after passage in December in the lower house.

They carried banners reading "No to Sarkozy Shame Law," "History for Historians, Politics for Politicians" or other slogans denouncing an alleged bid by President Nicolas Sarkozy to "fish for votes" among French Armenians before the two-round presidential elections in April and May.

Critics claim the real aim of the bill is to ensure votes for President Nicolas Sarkozy from French Armenians in the two-round presidential elections in April and May. An estimated 500,000 Armenians live in France.

The measure would make it a crime to deny that mass killings of Armenians in 1915 by Ottoman Turks constitute genocide. It sets a punishment of up to one year in prison and a fine of euro45,000 ($59,000) for those who deny or "outrageously minimize" the killings ? putting such action on par with denial of the Holocaust.

France formally recognized the 1915 killings as genocide in 2001, but provided no penalty for anyone refuting that.

Despite the passing of nearly 100 years since the killings, the issue remains a deeply emotional one for Armenians who lost loved ones and for Turks who see a challenge to their national honor.

An irate Turkey briefly recalled its ambassador to France and suspended military, economic and political ties.

"Politicians who haven't read an article on this say there was a genocide," said Beyhan Yildirim, 35, a demonstrator from Berlin. He was among those bused into Paris from Germany and elsewhere for Saturday's march.

Scores of buses from France, Germany and elsewhere lined the streets of southern Paris where the march began.

Armenians plan a demonstration near the Senate on Monday before the debate and vote.

It was unclear whether the measure would get the easy ride it did in the National Assembly, the lower but more powerful house.

The Senate is controlled by the rival Socialists who had earlier backed the bill. However, the Senate Commission on Laws voted against its passage last week, saying the measure risks violating constitutional protections including freedom of speech. The question is whether the Socialists will heed the recommendations if only because the issue is becoming an electoral hot potato.

Compromising freedom of expression in France, considered the cradle of human rights, has been a key argument of the Turkish government against the measure.

It is unclear whether lawmakers in the National Assembly had an inkling in advance that their vote giving the green light to the bill would trigger a diplomatic dispute. There appeared to be less than 100 lawmakers present for the Dec. 22 vote ? out of 577.

Fadime Ertugrul-Tastan, deputy mayor of small Normandy town of Herouville, was among those demonstrating against the bill on Saturday, wearing the blue, white and red sash of French officials.

She said her family hailed from Kars, near the Armenian border, and her grandparents were killed by Armenians.

"I am here to honor their memory," she said, adding, "There was no genocide because we were in a period of war."

Love hits 3 at buzzer, Timberwolves top Clippers (AP)

LOS ANGELES ? Kevin Love hit a 3-pointer at the buzzer after Ricky Rubio's tying 3 with 20 seconds to play, lifting the Minnesota Timberwolves to a pulsating 101-98 victory over the Los Angeles Clippers on Friday night.

Darko Milicic had 22 points and seven rebounds for Minnesota before fouling out with 1:01 left, and Love had 17 points and 14 rebounds.

The Timberwolves, coming off consecutive home wins over Sacramento and Detroit, have won three straight for the first time since a four-game stretch from Jan. 29 to Feb. 6, 2010. After that, they lost 29 of their final 31 games.

Rubio, Minnesota's rookie point guard, missed his first 10 field goal attempts before draining a clutch 3 from in front of the Clippers' bench.

Chauncey Billups missed a driving layup against Rubio coming out of a timeout, and Love got the rebound before Minnesota called a timeout with 1.5 seconds on the clock.

Luke Ridnour inbounded the ball in front of the midcourt line to a wide-open Love, whose only option was to catch and shoot from a few feet beyond the arc. The ball hit nothing but net as the sellout crowd groaned.

The victory snapped a seven-game home winning streak for the Clippers.

Mo Williams scored 21 of his 25 points off the bench in the first half for the Clippers before getting ejected midway through the fourth quarter. Blake Griffin had 21 points and 10 rebounds, and Billups finished with 20 points after getting into early foul trouble. Point guard Chris Paul missed his fourth straight game because of a left hamstring strain.

Williams received his second technical foul with 6:21 remaining, after he was called for fouling Rubio on a drive to the basket as Rubio lost his footing. The Timberwolves closed to 91-90 with 4:37 remaining after four consecutive free throws by Rubio. Billups responded with a 3-pointer and two free throws for a 98-94 Clippers lead.

Clippers starting forward Caron Butler, who shot a career-worst 1 for 12 on Wednesday night in a 91-89 win over Dallas after hyperextending his right knee the previous night at Utah, did not play against the Timberwolves.

Michael Beasley, whose game-winning jumper with 2.3 seconds to go capped a 33-point effort in the Timberwolves' first meeting with the Clippers last season, missed his eighth straight game due to a sprained right foot. Reserve guard JJ Barea was back in Minnesota nursing a sprained ankle that also will keep him out of Saturday night's game at Utah. Center Brad Miller and guard Martell Webster, both of whom resumed practice this week, also didn't dress.

The Timberwolves, whose only other lead came after Milicic's game-opening basket, opened the third quarter with a 12-1 run that sliced an 11-point deficit to 62-60. But that was as close as they got. Clippers coach Vinny Del Negro tried to stall Minnesota's momentum with a timeout after Milicic's slam dunk, and Billups responded with a 16-footer and a 3-pointer.

Billups, who hit clutch 3-pointers to nail down each of the Clippers' previous two wins against New Jersey and Dallas, got off to an inauspicious start against the Timberwolves with two fouls in the first 4:38 ? and a technical foul for complaining about the second one after he was called for a charge against Ridnour.

Williams replaced Billups and got a technical foul with 1:12 left in the opening quarter, after picking up his second personal on a charge against Ridnour and slamming the ball in disgust. Williams quickly regained his focus, making back-to-back 3-pointers and a driving layup in the final 51 seconds of the period to give the Clippers a 31-22 lead.

It was the second straight game in which Williams ? the Clippers' starting point guard last season before the acquisitions of Paul and Billups in December ? started out 7 for 7 from the field. Williams also made his first seven shots Wednesday night against the Mavericks, finishing with 26 points in a game the Clippers won on Billups' 3-pointer with 1 second on the clock.

Notes: Billups overtook Peja Stojakovic for fourth place in career 3-pointers (1,762). Ahead of him are Ray Allen, Reggie Miller and Jason Kidd. ... An MRI taken Thursday on Butler's knee revealed no structural damage. It was the same knee he had surgery on last January, which sidelined him for the rest of the season, but Del Negro said this injury was not related. ... Southwest posts $152M 4Q profit on strong traffic (AP)

DALLAS ? Even with a tough economy and high jet fuel prices, Southwest Airlines Co. made money in the fourth quarter and could do better this year.

Travel demand was strong enough in the final three months of 2011 for the carrier to keep planes nearly full and raise fares.

The carrier's fourth-quarter net income rose 16 percent to $152 million, and profit was slightly higher than analysts expected. Revenue jumped to $4.11 billion.

CEO Gary C. Kelly said he expects strong revenue in the first quarter too, based on passenger-booking trends.

People travel more when the economy is strong, and there are signs that growth is recovering from the 2007-2009 recession.

Auto sales picked up late last year. U.S. factory output rose sharply in December. And the stock market is up ? the Dow Jones industrial average has gained 3 percent so far in 2012.

"2012 is going to be better for Southwest. It's going to be a good year for the airline industry," said Ray Neidl, an analyst with Maxim Group LLC. "The airlines can double their profitability" over 2011.

Neidl said that's possible ? even with just modest economic growth ? because airlines are limiting flights, which keeps planes full and lets them raise fares.

In the fourth quarter, Southwest filled more than 80 percent of its seats, an unusually high percentage. And the average passenger paid a fare of $140.18, up 10 percent from a year earlier when including price increases at its AirTran Airways subsidiary.

At Southwest and most other airlines, the biggest challenge to making money will be high jet fuel prices.

Southwest paid 34 percent more at the pump to fill its fleet of Boeing 737s, and its fuel tab came to $1.49 billion for the final three months of the year. Fuel averaged $3.29 per gallon.

And there's little relief in sight. Southwest expects to spend $3.35 per gallon in the first quarter, up 14 percent from the same period last year.

Southwest tries to protect itself from fuel price spikes by hedging ? in effect, locking in some of its fuel spending at guaranteed prices.

All of Southwest's increase in fourth-quarter net income came from gains on fuel-hedging contracts. Without those one-time gains, Southwest's adjusted profit was $66 million, or 9 cents per share, down from $115 million, or 15 cents, a year earlier.

Still, the results beat analysts' prediction of 8 cents per share, according to FactSet.

Southwest shares rose 30 cents, or 3.3 percent, to $9.32 in midday trading.

With the addition of AirTran Airways, which Southwest bought last year, revenue rose to $4.11 billion.

Southwest paid $1.4 billion for AirTran, which allowed it to expand into Atlanta, Mexico and the Caribbean, but it said Thursday that the cost of combining the two airlines will end up at $500 million. The company said it saved $80 million in overlapping expenses in 2011 and expects the annual savings to go much higher.

Southwest, which carries more passengers in the U.S. than any airline, was the first major U.S. carrier to report fourth-quarter results. United Continental Holdings Inc., Delta Air Lines Inc. and US Airways Group Inc. will release their figures next week, and analysts expect all three to show operating profits for the usually weak fourth quarter.

AMR Corp.'s American Airlines is expected to report a loss and to keep losing money in 2012. The company filed for bankruptcy protection in November and has begun trimming marginal flights, which could push some travelers to its more-successful competitors.

(AP) ? Country music legend Merle Haggard is being treated for pneumonia in a Georgia hospital and has had to cancel the rest of his January concert dates.

Publicist Tresa Redburn said she spoke to Haggard by phone Wednesday in his Macon hospital room.

The 74-year-old Haggard was taken to the hospital Tuesday after canceling a Macon show at short notice. He had at least four more dates scheduled for the rest of this month, from Kentucky to Oklahoma.

Tour manager Frank Mull tells The Columbus Ledger-Enquirer (http://bit.ly/yPAGQW ) that Haggard has been sick since leaving his home in northern California last week.

Japan to let nuke plants to run after 40-year cap (AP)

TOKYO ? Japan is backtracking on plans formed only this month to shut down nuclear reactors after 40 years, saying it could allow some plants to run for up to 60 years.

Top Cabinet spokesman Osamu Fujimura said Wednesday that the government plans to stick to the 40-year cap in principle, but is considering allowing operators to apply for 20-year extensions.

Each reactor could get only one extension, and it would have to meet strict safety requirements to qualify, he said.

Concern about aging reactors has grown because three of those at the tsunami-hit Fukushima Dai-ichi plant were built starting in the late 1960s. Many more of Japan's 54 reactors will reach the 40-year mark in coming years.

Japan currently has no limit on years of operation.

The Genesis problem

THE term "big bang" was famously coined as a term of abuse. During a radio interview in 1949, cosmologist Fred Hoyle was pouring scorn on the idea that the universe simply popped into existence when he unwittingly invented a catchy name for the theory that eventually won out.

The big bang is now part of the furniture of modern cosmology, but Hoyle's unease has not gone away. Many physicists have been fighting a rearguard action against it for decades, largely because of its theological overtones. If you have an instant of creation, don't you need a creator?

Cosmologists thought they had a workaround. Over the years, they have tried on several different models of the universe that dodge the need for a beginning while still requiring a big bang. But recent research has shot them full of holes (see "Why physicists can't avoid a creation event"). It now seems certain that the universe did have a beginning.

Without an escape clause, physicists and philosophers must finally answer a problem that has been nagging at them for the best part of 50 years: how do you get a universe, complete with the laws of physics, out of nothing (see "Trying to make the cosmos out of nothing")?

Exclusive: Banker in Olympus scandal steps into public view (Reuters)

DELRAY BEACH, Florida (Reuters) ? A Japanese banker who is a key figure in the Olympus accounting fraud came into public view for the first time since the scandal broke, appearing on Friday at his divorce hearing in a Florida court.

Hajime "Jim" Sagawa ran a U.S. investment firm that earned a massive $687 million fee for advising Olympus in a 2008 acquisition deal that ranks as the largest advisory payment in history.

Olympus has admitted the deal along with others was part of a 13-year scheme to cover up $1.7 billion in losses in an accounting fraud that has caused the company's stock market value to drop around 40 percent since October.

The scandal, involving inflated advisory fees and prices in acquisition deals, has triggered investigations by law enforcement agencies in the United States, Japan and Britain.

An outside investigation commissioned by Olympus found the scheme was hatched by several key executives and aimed to hide losses from investors, but law-enforcement agencies are continuing their investigations.

The whereabouts of Sagawa, a former PaineWebber banker, were unknown until Reuters located him when he attended the divorce hearing in a state court in Delray Beach, Florida.

When asked about the Olympus case, he responded with a terse "no comment." Pressed further, he waved his hand and said "it's rude" to keep asking.

Dressed in a blue sport coat and gray slacks, Sagawa emerged with his ex-wife from a courtroom after a final divorce hearing.

The couple walked briskly to a parking garage after being asked again to comment on the scandal that has rocked Olympus and left the Japanese medical equipment and camera maker in need of a capital infusion and at risk of being delisted from the Tokyo Stock Exchange.

Sagawa ran the Axes America brokerage firm involved in Olympus' $2 billion takeover of British medical instruments company Gyrus.

The Gyrus fee was among several vehicles used by Olympus to disguise securities losses.

Axes America later allocated a large share of its $687 million advisory fee payment to Cayman-based AXAM Investments. That company was later struck off a company registry in the Cayman Islands.

Axes is also linked to another Japanese banker, Akio Nakagawa, whom Reuters located in Hong Kong in late November after he went on the run when the scandal was uncovered. He also declined to comment.

Olympus is suing its current president and 18 other past and present company officials over the scandal.

Until reports of the fraud emerged, Sagawa lived in a luxury waterfront house in Boca Raton, Florida, but was unable to be located afterward.

His ex-wife has repeatedly defended his involvement with Olympus and said she did not know where he was.

Sagawa has not responded to repeated emails and phone calls seeking more detail on Axes America's role in the scandal.

The Sagawas filed for divorce in October, days after the Olympus accounting fraud surfaced when the company's former chief executive, Michael Woodford, blew the whistle on the Axes America advisory fee and other deals.

In a divorce petition filed in October, the Sagawas, who married in 1979 in Tokyo, cited "irreconcilable differences."

The couple listed more than $11 million in combined assets and Sagawa reported a monthly income of $2,500 with $1,800 coming from social security and $700 from interest and dividend payments.

According to their settlement agreement, Ellen Sagawa will receive nearly $9.9 million in assets, including their Boca Raton home valued at $2.5 million. Also among the assets are $6.7 million held in a savings account.

Sagawa will keep nearly $1.5 million in assets that include $1.3 million in several retirement plans, $100,000 in a savings account and $100,000 in a brokerage account.

Supreme Court says no to new rule on eyewitness testimony

The lawyer for a convicted New Hampshire man had asked the Supreme Court to establish an expanded rule to help prevent unreliable eyewitness testimony at criminal trials.

The US Supreme Court on Wednesday declined to create a new constitutional rule that would have required judges to test the reliability of eyewitness testimony whenever the witness?s observations were made under suggestive circumstances.

In an 8-to-1 decision, the court said various trial protections, including specific jury instructions, are adequate to safeguard the fairness of trials where eyewitness testimony is introduced.

?The fallibility of eyewitness evidence does not ... warrant a due process rule requiring a trial court to screen such evidence for reliability before allowing the jury to assess its creditworthiness,? Justice Ruth Bader Ginsburg wrote in the majority opinion.

The issue arose in the case of a New Hampshire man, Barion Perry, who was arrested after a witness told police she had seen him remove a large box from her neighbor?s car.

When asked by police to identify the man, she motioned toward the window and said he was standing in the parking lot with a police officer.

A month later, however, the witness was unable to identify the suspect?s face in a police photo array.

Mr. Perry?s lawyers asked the judge at his trial to exclude the witness?s testimony. The judge refused, in part because the suggestive circumstances of Perry?s identification had not been orchestrated by police.

Perry was convicted.

On appeal to the Supreme Court, Perry?s lawyer asked the justices to establish a new rule that would help prevent unreliable eyewitness testimony from being introduced at criminal trials.

Under existing precedent, judges are required to screen witness testimony for reliability whenever police are suspected of using suggestive tactics. Such prescreening has been deemed necessary to preserve the fairness of a trial in the face of suggestive police procedures.

But Perry?s lawyer wanted the court to significantly expand that practice to all witnesses whenever an identification was made under suggestive circumstances.

Studies have shown that faulty eyewitness identifications are a big factor leading to wrongful convictions. One study found that eyewitness misidentifications contributed to the wrongful conviction of 76 percent of the first 250 individuals whose cases were overturned with DNA evidence.

Despite that acknowledged danger, the high court refused on Wednesday to establish a new rule.

?We hold that the due process clause does not require a preliminary judicial inquiry into the reliability of an eyewitness identification when the identification was not procured under unnecessarily suggestive circumstances arranged by law enforcement,? Justice Ginsburg wrote.

In a statement from the bench, Ginsburg said one reason to exclude eyewitness evidence that had been generated by suggestive police tactics was to deter police from using such tactics. ?The aim is to stop law enforcement officers from using improper arrangements, for example, suggestive lineups, showups, or photo arrays,? she said.

But she added, ?Where there is no improper police conduct, there is nothing to deter.?

Many factors, Ginsburg said, may cast doubt on the reliability of eyewitness testimony, including poor vision or a witness with a grudge. But the criminal justice system is designed to help a jury determine the reliability of evidence.

In a lone dissent, Justice Sonia Sotomayor said the court?s focus was misdirected toward police deterrence rather than the broader goal of witness reliability.

?The court?s holding enshrines a murky distinction ? between suggestive confrontations intentionally orchestrated by the police and, as here, those inadvertently caused by police actions ? that will sow seeds of confusion,? she wrote.

The holding, she said, ?ignores our precedents? acute sensitivity to the hazards of intentional and unintentional suggestion alike.?

The case is Perry v. New Hampshire (10-8974).

Astronomers have discovered the most distant developing galaxy cluster known to date, shedding light on the formation of large-scale structure in the early universe, a new study reports.

Researchers used NASA's Hubble Space Telescope to find five tiny but bright galaxies clustered together 13.1 billion light-years from Earth. That means Hubble is observing them as they existed just 600 million years after the Big Bang, the dramatic event that brought our universe into existence.

"These galaxies formed during the earliest stages of galaxy assembly, when galaxies had just started to cluster together," Michele Trenti, of the University of Colorado at Boulder and the University of Cambridge in the United Kingdom, said in a statement. "The result confirms our theoretical understanding of the buildup of galaxy clusters. And, Hubble is just powerful enough to find the first examples of them at this distance."

Trenti presented the results today (Jan. 10) at the American Astronomical Society meeting in Austin, Texas, the same day a different research team announced the discovery of "El Gordo," the largest galaxy cluster in the early universe. [See Hubble's photo of the faraway protocluster]

The study will also be published in an upcoming issue of The Astrophysical Journal.

A rare find

Hubble spotted the five galaxies while performing a random sky survey in near-infrared light.

The newfound galaxies are small, ranging from 10 percent to 50 percent the size of our own Milky Way. But they're about as bright as the Milky Way, because they're feasting on huge amounts of gas via mergers with other galaxies, researchers said.

Most galaxies reside in clusters or groups. Galaxy clusters are the largest structures in the universe, comprising hundreds or thousands of individual galaxies bound together by gravity. Hubble is seeing the five-galaxy protocluster as it existed 13.1 billion years ago; since then, it's probably grown to a size typical of its gigantic brethren, researchers said.

Hubble's new discovery offers a rare chance to observe ancient protoclusters, which are dim and widely scattered across the sky.

"We need to look in many different areas because the odds of finding something this rare are very small," said Trenti, who used Hubble's Wide Field Camera 3 (WFC3) to pinpoint the protocluster. "The search is hit and miss. Typically, a region has nothing, but if we hit the right spot, we can find multiple galaxies."

Galactic buildup

The new find helps demonstrate that galaxies build up progressively over time, researchers said. It also provides further evidence for the hierarchical model of galaxy assembly, which posits that small objects merge to form bigger ones in a steady process of collision and accretion.

The fledgling cluster may consist of more than just the five bright galaxies Hubble spotted. The team suspects that many fainter galaxies may inhabit the same cosmic neighborhood, researchers said.

The scientists estimated the distance to the newfound protocluster based on their colors, but they plan to follow up with spectroscopic observations, which measure the expansion of space. Those measurements will help pin down the cluster's precise distance, researchers said.

Spectroscopic observations will also allow researchers to determine the galaxies' velocities, which should show whether they are gravitationally bound to each other.

Jeanne Baret was passionate about science. So passionate that, in the 1760s, the Frenchwoman disguised herself as a man. She hid her true identity to accompany her lover, botanist Philibert Commerson, on the first French ship to sail around the world. At the time, women weren?t allowed on French navy vessels, and general sexism prevented them from working in science.

Commerson was sick for part of the trip, and so Baret accomplished much of the fieldwork on her own. Together the two collected more than 6000 specimens. More than 70 species have been named for Commerson. He intended to name a species after Baret, but he died before he could do so.

An exotic species for an unusual woman, who made a mark on science without leaving her name. Until now.

German Renewable Energy Jobs Failing to Pan Out (ContributorNetwork)

According to a January 7 AFP report, when Germany decided to get away from nuclear energy and look to renewable sources, Chancellor Angela Merkel said that more jobs would be provided than lost by the change in energy policy. However, as companies announce the cutting of jobs in the country, some analysts say that isn't the case.

Solar lobbyists in Germany estimate that the move away from nuclear energy could create as many as 500,000 new jobs. According to RWI institute researcher, Manuel Frondel, though, solar-industry jobs cost consumers the euro-equivalent to $318,000 U.S. dollars apiece, the AFP article stated, due to the fact that renewable projects tend to be high capital, low job-producing endeavors. Meanwhile, since the announcement of Germany's changing energy policy was made last spring, the country's biggest power supplier, EON, has announced that it will reduce its workforce by 11,000. Another supplier, RWE, has announced cuts of 8,000 jobs. Additionally, Areva will cut 1,200 jobs at its German subsidiary due to restructuring.

As of June, 2011, according to a report by the Global Post, nearly one quarter of Germany's power was generated from nuclear plants, while renewable energy sources provided seventeen percent. The country's decision to shut down all of its nuclear plants by 2022 was met with skepticism not just in how many jobs could be lost, but how the country would be able to meet its future energy needs.

Also in June, the Christian Science Monitor published an article wondering if the United States government might also opt out of nuclear power. According to Mark Hibbs, a senior associate with the nuclear policy program at Carnegie Endowment for International Peace, if the transfer away from nuclear proved to work well in Germany over the next ten years, the U.S. very well might consider it. The U.S. currently gets about a fifth of its power from nuclear generation.

According to Christine Todd Whitman, former EPA administrator and former New Jersey governor, the nuclear energy industry currently supports more than 100,000 jobs. Eight new nuclear facilities are planned to be build in the next fifteen years, providing jobs for "thousands of skilled workers."
