Doctor to be sentenced for Michael Jackson's death

(AP) ? Michael Jackson's doctor will face the singer's distraught family and ardent fans one more time when he returns to court for sentencing in the death of the superstar from an overdose of an operating-room anesthetic he was receiving to battle insomnia.

Dr. Conrad Murray's sentencing Tuesday for involuntary manslaughter is the final step in the criminal case launched within days of Jackson's unexpected death in June 2009.

Prosecutors want a judge to sentence the 58-year-old Murray to the maximum four-year prison term. Defense attorneys counter that Murray already faces a lifetime of shame and diminished opportunities and should receive probation.

How long Murray might remain behind bars depends on the Los Angeles Sheriff's Department, which would base the decision on good behavior and other factors.

Even without overcrowding and a new state law that will send Murray to county jail rather than prison, a four-year sentence could be cut in half by good behavior.

It remained unclear Monday whether Jackson's family will speak during the sentencing hearing. His mother Katherine and several siblings routinely attended the six-week trial that ended with the conviction on Nov. 7.

Prosecutors portrayed Murray as an incompetent doctor who administered propofol ? an extremely potent anesthetic normally used during surgery ? in Jackson's bedroom without adequate safeguards and botched his care when things went wrong.

The prosecution is also seeking restitution for Jackson's three children and filed a statement from the singer's estate stating the cost of the singer's funeral was more than $1.8 million. The letter also notes that Jackson would have earned $100 million if he had performed a planned series of comeback concerts in London.

The doctor's fate lies with Superior Court Judge Michael Pastor, who will determine the sentence and had harsh words for Murray on the day he was convicted.

"Dr. Murray's reckless conduct in this case poses a demonstrable risk to the safety of the public," Pastor said before the Houston-based cardiologist was led from the courtroom in handcuffs.

Pastor also could address Murray's decision to participate in a documentary that was filmed throughout the trial and aired days after Murray's conviction.

Murray states in the film that aired on MSNBC, under the title "Michael Jackson and the Doctor: A Fatal Friendship," that he doesn't feel guilty about the singer's death because he doesn't think he did anything wrong.

Prosecutors cited Murray's comments in their filing last week urging the judge to impose the maximum sentence.

"Finally, the defendant consistently blames the victim for his own death," the prosecutors said, "even going so far as to characterize himself as being 'entrapped' by the victim and as someone who suffered a 'betrayal' at the hands of the victim."

Murray's attorneys are relying largely on statements from his former patients to portray Murray in a softer light and win a lighter sentence.

"There is no question that the death of his patient, Mr. Jackson, was unintentional and an enormous tragedy for everyone affected," defense attorneys wrote in their sentencing memo. "Dr. Murray has been described as a changed, grief-stricken man, who walks around under a pall of sadness since the loss of his patient, Mr. Jackson."

Pastor also will review a report by probation officials that carries a sentencing recommendation. The report will become public after Murray is sentenced.

The report may also feature input from Murray, who chose not to testify in his own defense during the trial but was heard in a lengthy interview recorded by police.

Murray's trial was closely watched by Jackson's fans in the courtroom, on social networking sites and via live broadcasts online and on television.

The trial detailed the final hours of Jackson and portrayed him as a talented genius suffering from debilitating insomnia.

The singer selected Murray as his personal physician, and the doctor began giving Jackson nightly doses of propofol two months before the singer's death.

Several doctors who testified during the trial, including Murray's own hired propofol expert, said they would not have given Jackson the treatments in his bedroom and that Murray violated the standard of care multiple times.

Online shopping sales surge 26 pct on Black Friday

On the eve of "Cyber Monday," online retailers reported an even stronger start to the holiday shopping season than brick-and-mortar stores.

Research firm comScore reported on Sunday that e-commerce spending jumped 26 percent on Black Friday, the day after Thanksgiving, compared with the same day a year ago. ComScore reported $816 million in online sales for the day, up from $648 million.

The 26 percent growth rate for online sales compares with a 7 percent retail sales increase reported for Black Friday by ShopperTrak, which gathers data from individual stores and shopping malls. At $11.4 billion, the brick-and-mortar sales total still dwarfs the online total.

Gian Fulgoni, comScore chairman, said in a statement that e-commerce enjoyed a banner day, despite some analysts' predictions that early store openings on Black Friday could hurt online sales.

"With brick-and-mortar retail also reporting strong gains on Black Friday, it's clear that the heavy promotional activity had a positive impact on both channels," Fulgoni said.

Thanksgiving is also a big day for online sales, and comScore reported an 18 percent increase this year compared with a year ago, with $479 million in sales.

Online sales also have been strong throughout November. Online sales through Saturday rose 15 percent compared with the same period a year ago, according to comScore, which is based on Reston, Va. Through the first 25 days of the month, online sales have totaled $12.74 billion.

ComScore said 50 million Americans visited online retail sites on Black Friday, up 35 percent from a year ago. Each of the top five retail sites reported double-digit gains in visitors, in percentage terms, led by top retail site Amazon. Walmart ranked second, followed by Best Buy, Target and Apple.

Next up is Cyber Monday, when many online retailers run promotions for the first business day of the week following Thanksgiving. Cyber Monday sales topped $1 billion last year, making it the heaviest day of online spending ever. ComScore's Fulgoni expects another record will be set this year.

Toys R Us got a jump on things by offering Cyber Monday deals beginning at 6 p.m. on Sunday. The retailer's website also offered free shipping on purchases of $49 or more, through the holiday weekend until Dec. 3.

Amazon and Walmart launched weeklong online sales promotions on Sunday. Amazon's offers included a discounted price of $259 on a Kindle DX e-reader that normally sells at $379. That offer was scheduled to end Monday. Walmart expanded its Cyber Week offerings with more than 250 online-only specials, with savings of up to 40 percent. Walmart also offered free shipping on orders of $45 or more.

ComScore reported online sales for Black Friday two days after another researcher, IBM Corp.'s Coremetrics unit, reported a smaller online spending gain for Black Friday. Coremetrics reported a 20 percent increase, compared with comScore's 26 percent.

To protect your own interests, contact your insurer and take out a policy which will cover you for the move. This might be for just one day or for weeks, depending on where you are moving and how long the journey will take. Talk with your insurers as soon as you have a closure date and know when you will be moving. Don?t leave this until the last minute.

(AP) ? Yemen scheduled early presidential elections for early next year on Saturday in line with a power-sharing deal aimed at ending a nine-month political crisis, according to the country's official news agency.

The agreement would make President Ali Abdullah Saleh the fourth dictator pushed from power this year by the Arab Spring uprisings, although it has been rejected by many protesters because it would grant the reviled leader immunity from prosecution and does not include far-reaching political changes like those brought about by the uprisings in Tunisia, Egypt and Libya.

The U.S.-backed Gulf Arab proposal signed Wednesday in the Saudi capital Riyadh calls for Saleh to pass power to his deputy within 30 days, after a new government sworn in by the vice president passes a law protecting Saleh and his associates from prosecution. Presidential elections also were to be held within 90 days, well ahead of the original date in 2013.

It came after months of resistance by the leader of 33 years despite massive protests calling for him to step down. Saleh had agreed to sign the deal at least three previous times only to back out at the last minute.

Vice President Abed Rabbo Mansour Hadi said Saturday that the vote will be held on Feb. 21 and no party has the right to annul or change the decree, SABA reported. He made the announcement after Saleh gave him "the constitutional authorities to carry out dialogue with the parties that signed the Gulf initiative."

While it was welcomed by the U.S., which fears instability in the country that's home to one of the world's most active al-Qaida branches, the agreement has failed to end the mass protests that have rocked Sanaa and other cities since February.

Thousands took to the streets on Saturday to demand that Saleh face trial for allegations of corruption and the killing of hundreds of protesters as his security forces brutally tried to end the uprising against him.

The deal doesn't explicitly ban Saleh from the country's political life ? raising fears he could continue to play a political role.

Violence also continued, with Yemeni warplanes killing 80 anti-government tribesmen who overran part of a military camp in the Arhab region north of the capital.

The official, who spoke on condition of anonymity because he was not authorized to brief the media, said that warplanes and artillery had pounded the armed tribesmen for the past two days.

The number of deaths was not confirmed. But a soldier from Yemen's 63rd Brigade who fled the camp said tribesmen had overrun it several days ago. He spoke by telephone from Arhab, asking not to be identified for fear of government reprisal. The soldier said the tribesmen killed about 20 soldiers.

Union Leader endorses Newt Gingrich (The Ticket)

NAPLES, Fla. -- Republican presidential candidate Newt Gingrich pushed back against opponents who accused him him of supporting "amnesty" for illegal immigrants based on comments he made at a recent debate in Washington, DC,?on immigration reform.

Gingrich fielded criticism this week after arguing that some illegal immigrants with close ties to their community should not be deported.

"Several of my friends were explicitly distorting what I said, even though they knew better," Gingrich said at a campaign stop in Naples, Fla., on Friday. "So I think it takes a few days to clarify that in fact what they are saying isn't true."

Under Gingrich's plan, which he has articulated before, the federal government would establish a system of local boards to determine whether illegal immigrants could be permitted to remain in the United States based on their ties to the community.

"I propose that we take the World War II model of the selective service program," Gingrich said. "In World War II, local community citizens judged who ought to be drafted and who shouldn't . . . . It requires trusting citizens rather than bureaucrats. It's a jury system for local communities."

Gingrich added that he thought that immigrants eligible to stay should have spent at least 25 years in the country, have close ties to a community and a family, but predicted that most would voluntarily leave.
